1. Scope
These General Terms and Conditions (T&Cs) govern the use of the kizi.ch platform (hereinafter "platform"), operated by Sophia Koster, Seestrasse 21, 8703 Erlenbach, Switzerland (hereinafter "operator").
By registering on the platform, you agree to these T&Cs.
2. Description of services
kizi.ch is a matching platform for childcare services in Switzerland. The platform enables:
- Parents: to search for, compare and contact childcare services (daycare centres, playgroups, childminders, nannies).
- Providers: to present their childcare offerings, publish available places and handle enquiries from parents.
The operator merely facilitates contact between parents and providers. A childcare contract is concluded exclusively between the parents and the respective provider. The operator is not a party to this contract.
3. Registration and account
Registration is required to use certain features. Information provided during registration must be truthful.
- Each person may create only one account.
- Access credentials must be treated confidentially and must not be shared with third parties.
- You are responsible for all activities carried out through your account.
- Registration is available to natural persons aged 18 or over and to legal entities.
4. User obligations
4.1 General obligations
All users undertake to:
- Use the platform only for its intended purpose.
- Not publish any false, misleading or unlawful content.
- Not disseminate any offensive, discriminatory or inappropriate content.
- Respect the rights of other users and third parties.
- Not send mass communications (spam) via the platform.
4.2 Special obligations for providers
Providers additionally undertake to:
- Provide truthful information about their childcare offerings.
- Keep available places up to date.
- Hold all required permits and qualifications.
- Respond promptly to enquiries from parents.
- Comply with all applicable laws and regulations regarding childcare.
5. Communication on the platform
Communication between parents and providers takes place via the platform's integrated messaging system.
- Messages are stored on our servers (see privacy policy).
- Sharing personal contact details (phone number, email) with other users is at your own risk.
- The operator reserves the right to review messages in the event of concrete suspicion of unlawful content or upon a court order. No systematic monitoring of communications takes place.
6. Costs and payment terms
Basic use of the platform is currently free of charge. The operator reserves the right to offer paid additional services in the future (e.g. premium profiles for providers). Registered users will be informed of any price changes at least 30 days in advance by email.
7. Liability
7.1 Liability of the operator
The operator is not liable for:
- The accuracy, completeness or timeliness of content posted by providers.
- The quality of childcare services offered.
- Damages arising from the use of the platform or the conclusion of a childcare contract.
- Temporary outages or technical disruptions of the platform.
- Third-party content and external links.
The operator's liability for slight negligence is excluded to the extent permitted by law.
7.2 Liability of users
Users are liable for all damages arising from the violation of these T&Cs or from unlawful use of the platform.
8. Intellectual property
All content on the platform (design, texts, graphics, logos, software) is protected by copyright and is the property of the operator or licensed.
Users grant the operator a non-exclusive, free-of-charge, unlimited licence to use content published on the platform, to the extent necessary for its operation. This right expires upon deletion of the account.
9. Suspension and termination
- Users may delete their account at any time.
- The operator may suspend or delete accounts for good cause, in particular in the event of a violation of these T&Cs, suspicion of abuse or unlawful conduct.
- In the event of suspension or deletion, there is no entitlement to restoration of content.
- The operator will inform affected users of the suspension.
10. Amendments to the T&Cs
The operator reserves the right to amend these T&Cs at any time. Registered users will be informed of significant changes at least 30 days in advance by email. If you do not agree with the changes, you may delete your account before they take effect. Continued use of the platform after the changes take effect constitutes acceptance.
11. Final provisions
- Applicable law: Swiss law applies exclusively.
- Jurisdiction: the place of jurisdiction is Erlenbach ZH, to the extent permitted by law. Mandatory statutory places of jurisdiction (in particular Art. 32 CPC for consumer contracts) are reserved.
- Severability clause: should any provision of these T&Cs be or become invalid, the validity of the remaining provisions shall not be affected.
